DUI

DUI (Overview)

If you’ve been involved in a DUI, then you need the services of a skilled defense attorney. DUIs are not only embarrassing, they can also carry very costly penalties. Without an attorney to advocate for your rights, the prosecution will likely seek the maximum penalty, which could leave you with hefty fines, a tarnished permanent record, or even a jail sentence. Even first time offenses can sometimes land you with severe penalties. You have the right to legal representation. Extreme DUI

As serious as receiving a DUI is, there are certain modifying factors that can increasing the severity of the charges. According to state laws, if your blood alcohol content (BAC) exceeds .15%, then you are liable to be charged with an “Extreme” DUI. Because the seriousness of the charges increases with your blood alcohol percentage, if your blood alcohol content happens to exceed .20%, then you can be charged with a “Super Extreme DUI,” which of course may carry incrementally worse penalties.

Aggravated DUI

While even “Super Extreme DUIs” still remain misdemeanors (albeit very serious ones), DUIs that are “Aggravated” are considered felonies. The punishments for these crimes are understandably severe, as there are aggravating factors in these cases that take the crime from bad to worse. If you’ve been charged with an Aggravated DUI, then you need an experienced attorney to advocate on your behalf.

Four Ways to Receive an Aggravated DUI

According to the statute, committing one or more of the following four acts may lead to you being charged with an Aggravated DUI:

  • Receiving 3+ DUIs within a seven year period
  • Being charged with a DUI while carrying a passenger under the age of 15
  • Receiving a DUI after your license has already been suspended or revoked
  • Committing a DUI while an ignition interlock device (IID) is installed in your vehicle

The experienced team of attorneys at GillespieShields are experienced at navigating these matters in the Arizona system and can help advocate for your rights in your DUI case.
